In order for FC-SW-3 to meet the requirements for standardization by ISO/IEC JTC1, a similar disclosure must also be sent to the IEC. The document cannot be standardized without a letter from each company that has previously claimed applicable intellectual property. A letter with the following information should be sent to the IEC offices: a) The patents held, if possible. b) The statement of a commitment to license according to IETF requirements, particularly "reasonable and non-discriminatory" and "world-wide". c) The contact information for licensing agreements. Appropriate text might be something like: [Company] is the owner of patent[s] number nnnn. We believe that the patent[s] is[are] applicable to ISO/IEC 14165-251: Information technology - Fibre Channel - Part 251: Fibre Channel Framing and Signaling Interface (FC-FS). [Company] confirms that as the holder of applicable patent[s], [Company] will meet the requirements of ISO/IEC directives. If compliance with ISO/IEC 14165-251 requires the use of the patent[s] [Company] agrees to negotiate world-wide licenses under reasonable and non-discriminatory terms and conditions with applicants throughout the world.
